TJRS overturns one of the injunctions preventing the signing of a Corsan sales contract

The legal discussion on whether or not to sign the contract for the sale of Companhia Riograndense de Saneamento (Corsan) gained another chapter this Wednesday (22). The Court of Justice of the State of Rio Grande do Sul (TJRS) revoked one more of the injunctions that prevent the agreement from being signed. Despite this, other actions still make it impossible for the government of Rio Grande do Sul and the Aegea Consortium (which won the auction for the state-owned company disputed in December last year) to confirm the deal.
The president of the Union of Workers in the Purification and Distribution of Water and Sewage Services of the State of Rio Grande do Sul (Sindiágua/RS), Arilson Wünsch, details that on Friday (17) an injunction had already fallen within of the Labor Court and this Wednesday, at TJRS, the action that maintained that the State needs to have a structure that executes the sanitation service in Rio Grande do Sul was revoked. Despite this most recent decision, the leader is confident that it will be possible to avoid confirming the sale of the state-owned sanitation company.
The trade unionist hopes that it will be possible to implement a Parliamentary Inquiry Commission (CPI) on the privatization of Corsan. In addition, Wünsch recalls that there are still lawsuits pending at the TJRS and the State Court of Auditors (TCE) that question issues such as the pricing of Corsan’s sale, as well as the validation of contractual amendments that the company signed with some municipalities it serves. The initial bid for the sanitation company was set at R$ 4.1 billion and Aegea won the bid as the only participant, with a premium of only 1.15%.
Wünsch recalls that the schedule of the privatization process predicted that the agreement between the State government and Agea would be signed until this last Monday (20), however that did not happen. “It was yet another resounding defeat for the government not to have managed to sign the contract yet”, stresses the leader. However, the president of Sindiágua / RS admits that he fears that Justice will begin to judge the case of Corsan under pressure from the government of Rio Grande do Sul.
