There is no tax regime without changes in Carf, says Guimarães – 7/4/2023 – Market

The leader of the government in the Chamber of Deputies, José Guimarães (PT-CE), said this Tuesday (4) that it is not possible to maintain a sustainable fiscal regime without the approval of the bill that recreates the casting vote in CARF ( Board of Tax Appeals) in favor of the Federal Revenue in the event of ties in the decisions of the collegiate.

“It is a necessity. There is no fiscal regime without CARF, which is one of the complementary measures that help the country to consolidate a sustainable fiscal regime”, said Guimarães in an interview with GloboNews.

“We will vote on this text [do projeto de lei do Carf] today. We are going to vote and everyone needs to understand, because there is no point in voting for the new tax regime if we do not contribute, for example, to the federal government’s collection”, added the leader to the broadcaster.

Guimarães’ speech comes after the FPA (Frente Parlamentar da Agropecuária), one of the most relevant in Congress, released a note positioning itself against the casting vote in favor of the Revenue in Carf, which is the last administrative instance of appeals against punishments imposed by Revenue.

The FPA stated that the bill, defended as a priority by the Minister of Finance, Fernando Haddad, “hurts the existence of the Council itself with the intention of immediate tax collection, leaving aside the technical and fair way that characterizes the performance of CARF” .

The government leader, however, said that the text of the bill was negotiated with party leaders in the Chamber.

“Carf, the text, has been negotiated with the rapporteur, with the leaders since Sunday night and therefore we have unity here in the Chamber on the content, on those issues that are central”, said the deputy.

Guimarães also defended that the Chamber vote on the tax reform proposal later this week and a dialogue with governors who have shown resistance to points in the text of the rapporteur for the matter, deputy Aguinaldo Ribeiro (PP-PB). The leader stated that the reform will be an “extraordinary sign” for the economy and that differences in relation to the text of the matter need to be resolved in the vote.

“It is essential (to vote on the tax reform this week). That is why we were summoned, from Monday, yesterday, until Friday (7)”, said the leader.

“I defend the thesis that, even with all the limitations that may occur in the vote here in the Chamber, the Senate corrects it. What we cannot, governors, is stop this debate here in the Chamber. That is why we were summoned here “, he said.

In addition to the Carf bill, which locks the Chamber’s agenda, and the tax reform, the President of the House, Arthur Lira (PP-AL), also intends to conclude this week the vote on the proposal for a new fiscal framework, which returned to House after being modified in the Senate.

Guimarães told GloboNews that he does not expect problems in voting on this matter and that it will be necessary to find a consensus between those who defend maintaining the changes made by the senators in the text and those who want to return to the original text approved by the Chamber.

“I don’t think we will have a problem. For me, I would keep the Senate text so as not to cause more confusion, we already have too much confusion this week here, especially in tax reform, so let’s focus on tax reform, which I think is central for the country”, he defended.
