Suspension of land sales affects Batista’s business – 04/29/2023 – Panel SA

STF (Federal Supreme Court) minister André Mendonça said that the matter was not a priority, but, in less than a month, he suspended by injunction all operations of purchase and sale of rural land by foreigners in the country.

The decision, taken monocratically, was submitted to the plenary. The judgment can be closed this Sunday (30) by the virtual plenary of the STF. Mendonça, the case’s rapporteur, was accompanied by Minister Edson Fachin. Alexandre de Moraes was against it.

The precautionary measure was a request from the Federal Council of the OAB, which, through the commission that petitions the Supreme Court, asked to enter as amicus curiae –a kind of interested advisor– in an action stopped since 2015. On the merits, it discusses the rules so that foreigners can buy rural land in the country.

In the action, the OAB claims that the matter interferes with billionaire businesses in progress, such as Eldorado Celulose – whose control has been disputed in an arbitration questioned in court between J&F, of the brothers Joesley and Wesley Batista, and the Indonesian group Paper Excellence . The litigation involves the fate of at least R$ 6 billion.

Eldorado maintains several farms for the production of raw materials.

Paper representatives say the suspension of land transactions could force the Indonesians to withdraw from the dispute.

The most controversial point in the OAB movement is that the chairman of the commission that works with the Supreme Court is Marcos Vinicius Furtado Coelho. He is J&F’s arbitration attorney and former president of the bar.
When consulted, he denied, via advisory, any role in the process before the Supreme Court. He is not the one who signs the play, but his assistant at the OAB body.

The column questioned the OAB for having entered as an interested party in the process only at this moment.
Through its advisory, the entity said that the Federal Council is the legitimate institution to act in the STF.

He informed that the suggestion of joining the action was made only this year by the National Commission on Human Rights and approved, unanimously, by the plenary of the entity, formed by 81 counselors.
Marcos Vinícius also informed that he “never requested an opinion on this matter from the Human Rights Commission”.
