Deputy Beto Pereira (PSDB-MS) stated that he intends to present his report to the government’s Bill 2384/23, by Wednesday (21), which reintroduces the casting vote in the decisions of the Administrative Council of Tax Appeals ( Carf). Pereira said that, after presenting the opinion, he should collect suggestions from the party benches.
The measure consists of establishing judgments favorable to the government in the event of ties in demands presented to the body, which accepts requests for tax review from 60 minimum wages, or close to R$ 80,000, reported Agência Câmara.
For the rapporteur, the federal government cannot have a vision of collecting more taxes, but of promoting tax justice, and for that the CARF must function as an administrative court that guarantees equal treatment between the parties. In his words, CARF cannot favor the Tax Authorities in a blatant way, nor the taxpayer in the same way.
The issue had already been addressed by the government through a provisional measure, which claimed tax losses of almost R$ 60 billion with the understanding that the tie should always favor the taxpayer. Carf’s proposal replaces Provisional Measure 1160/23, edited at the beginning of the year, with the same purpose. The MP expired on June 1 without being voted on by parliamentarians.
