The new guarantee framework should encourage extrajudicial negotiations and ensure up to 40% debt recovery.
The projection is from the Brazilian Title Protest Studies Institute (IEPTB). According to the entity, currently, only 15% of enforcement processes are concluded with payment to the creditor, even after the case ends up in court.
Currently being processed in the Chamber of Deputies, the framework creates incentives for the debt to be negotiated outside of Justice. One of them is the registration of the value of the debt recognized in the assets registered with a notary that, eventually, are given as guarantees for loans or other financial transactions.
With this type of “reinforcement” of guarantees, banks project that the cost of credit will be reduced. In the case of vehicle financing, this reduction will be 20%.
