Lewandowski votes partially against restrictions of the State-Owned Companies Law in the STF – 03/10/2023 – Market

Minister Ricardo Lewandowski, rapporteur at the STF (Federal Supreme Court) of an action proposed by the PC do B against bans on politicians in charge of public companies, gave a partial vote in favor of questioning the State-Owned Companies Law, sanctioned in 2016 by the then interim president Michel Temer (MDB).

In a vote published early this Friday (10), Lewandowski partially upholds the action and declares the unconstitutionality of the veto to appointments of ministers, secretaries, office holders, without permanent link with the public service, of a special nature or management and superior advice in public administration.

Through a direct action of unconstitutionality, the PC do B tries to overturn devices that restrict appointments, for state-owned companies, of directors and directors who hold some public office and or who have acted, in the previous three years, in the structure of a political party or in an election campaign.

The prohibition is foreseen in article 17 of the State-Owned Companies Law.

The vote was cast in a virtual session of the STF. Other ministers will still manifest themselves in favor or against the rapporteur.

The action in the STF is seen as one of the Lula government’s alternatives to open the way for the appointment of politicians to positions in public companies.
