Justice denies recovery of BRL 1 billion to Dias Pereira group – 07/16/2023 – Panel SA

The STJ (Superior Court of Justice) ruled that the Dias Pereira family must hand over the Três Irmãos and Santa Maria farms to creditors. The group operates in agribusiness and owns land in Rondonópolis, Paranatinga, Juscimeira and Chapada dos Guimarães.

With debts of almost R$ 1 billion, the family is accused of fraud to enable a judicial recovery process (RJ).

In the request, it is stated that the estate of Jairo Dias Pereira, who died in 2021 from Covid, left debts that had been legally collected since 1986. Banco do Brasil, for example, has been trying to execute a credit since 1996.

In 2022, shortly after the businessman’s death, his name was used to open a company at the Board of Trade of the State of São Paulo with the assets of the estate.

According to lawyer Luis Felipe Salomão, who represents creditors, it was an attempt to shield assets.

“It was never a business group, but just an estate that sought the protection of Justice by distorting the judicial recovery law,” said Salomão.

According to the lawyer, one of the family’s maneuvers was a request for annulment of the land award (transfer of possession), given for the payment of debts. At the end of June, the STJ denied the request.

At the same time, the Dias Pereira family tried to reverse the decision of the Court of Justice of Mato Grosso, which suspended RJ.

According to the opinion of the Public Ministry of Mato Grosso, the group had only 12 employees and did not present financial statements to justify the RJ.

In addition, among the assets listed, there were unproductive farms, which indicated the impossibility of reversing the group’s economic situation.
