Judge suspected of slave labor says he will recognize alleged victim as affective daughter – 06/11/2023 – Market

Judge Jorge Luiz de Borba, from the Court of Justice of Santa Catarina, suspected of subjecting a woman to work analogous to slavery, said this Sunday (11) that he will judicially recognize the woman as an affective daughter.

In a note sent to Sheet, the judge’s family said they intend to collaborate with all administrative and judicial instances. “Whether there are no doubts about the actual situation in relation to the woman, or so that the investigations move forward quickly in order to allow the resumption of family life”, he says.

The document also states that all rights as an heir will be guaranteed to the woman. “We will accept all the suggestions made by the government, in addition to those that the family has already adopted throughout its life, to benefit its development”.

Recognition as an affective daughter or foster child is regulated by article 7, item II, of Law n. 3,765/60 combined with article 50, § 2, of Law n. 6,880/80, which state that the person recognized as such fits in the same situation as a stepdaughter or adopted daughter; and the condition of a daughter is equivalent to a stepdaughter created and maintained despite the absence of blood ties, having the same treatment given to a biological child.

The note is signed by Judge Jorge Luiz de Borba, his wife, Ana Cristina Gayotto de Borba, and their four children, Maria Leonor, Maria Alice, Maria Julia and Jorge Luiz.

UNDERSTAND THE CASE

Last Tuesday (6), the Federal Police claimed to have found a woman in a situation analogous to slavery in the home of Judge Jorge Luiz de Borba. He is suspected of keeping the worker in these conditions for at least 20 years.

In a note sent to Sheet at the time, the judge denied any accusation of work analogous to slavery in his residence, as well as mistreatment or unhealthy conditions.
Also according to the note, “all clarifications are and will continue to be provided to exhaustion to show that the complaint presented is not consistent with the truth”.

The note reiterates that the judge’s family was taken by surprise by the Federal Police’s search and seizure operation.

Borba says that the main focus of the family is the physical and emotional well-being of the woman, who, according to the note, has cognitive, speech and hearing deficiencies. “Believing that the truth will prevail and everything will be clarified, it reiterates its total willingness to collaborate with Justice”, she concludes.

According to the Penal Code, in article 149, work analogous to slavery is characterized by the submission of someone to forced labor or exhausting work, in degrading conditions, or restricting, by any means, their locomotion due to debt with the employer .
