IR 2023: submission of declaration begins on March 15 – 02/14/2023 – Market

The Federal Revenue changed the deadline for delivering the 2023 Income Tax declaration. Starting this year, taxpayers will have a longer deadline, from March 15 to May 31. In general, tax delivery began on the first working day of March and continued until the end of April.

During the pandemic, the deadline had also been extended for three years in a row, in 2020, 2021 and 2022. According to the tax authorities, however, the change that takes effect from now on aims to allow, from the beginning of the delivery, all taxpayers can have access to the pre-filled IR statement.

As most information on taxpayer income only reaches the Revenue at the end of February, the deadline companies have to deliver corporate declarations, the longer deadline will make the Income Tax campaign already start with all the functionalities offered to all taxpayers. In 2022, the release was in parts.

“A [declaração] pre-completed provides fewer errors and greater convenience to the taxpayer”, says tax auditor José Carlos Fernandes da Fonseca, national supervisor of the IR.

The rules for completing the document will be announced by the Revenue at the end of this month. However, they should not be very different from last year, as they are linked to the legislation on the subject.

Although Congress should soon debate a tax reform proposal that includes the Income Tax, the changes should not apply to this year’s declaration, which is based on the year 2022.

IR table has not been updated

The discount table was not updated by the government last year. With this, taxpayers who received taxable income above R$ 28,559.70 in 2022, which includes salary and retirement, for example, should be required to declare the IR in 2023.

Must be obliged to declare the IR who, in 2022:

• Received taxable income above BRL 28,559.70, which includes salary, retirement and pension, for example

• Received exempt income, non-taxable or taxed exclusively at source (such as savings income or FGTS) above BRL 40,000

• Had capital gain (ie, profit) on the sale (transfer of ownership) of goods or rights subject to the incidence of tax; This is the case, for example, of the sale of a car with a value greater than the amount paid for the purchase.

• Was exempt from IR on capital gain on the sale of residential properties, followed by the acquisition of another residential property within 180 days

• Carried out operations on the Stock, Commodity, Futures and similar exchanges

• Had, on December 31, possession or ownership of assets or rights, including bare land, in excess of BRL 300,000

• Obtained gross revenue in rural activity in an amount greater than R$ 142,798.50

• If you want to offset losses from rural activity in 2022 or previous years

• He moved to Brazil in 2022 and was in that condition on December 31

How the pre-populated statement works

The new filling modality began to work in 2022, but was only available to taxpayers with a silver or gold account on the Gov.br portal. In all, 10 million citizens benefited. Access to the pre-filled document is done at the e-CAC (Virtual Service Center of the Federal Revenue), through the program installed on the computer or by cell phone or tablet, through the Meu Imposto de Renda app.

The main cards are filled. The first one is the taxpayer information, which comes with the data declared to the Federal Revenue in the previous year. If there are dependents, their names and documents will also be on the “Dependents” sheet.

The taxpayer can, however, include or exclude information. It is very important to check all the data before sending it to the tax authorities, because they are the citizen’s responsibility, and can make the person fall into the fine mesh.
