Insurance sector supported resumption of 20-year project – 03/12/2023 – Panel SA

The request for the unfiling in the Senate of the project on the insurance market, which has been pending in Congress for about 20 years, received the support of representatives of the sector.
The topic was approved by the Chamber in 2017, but ended up shelved in 2022. The proposal addresses obligations and rights of brokers, insurers and customers. Topics range from the formatting of contracts, to provide greater transparency in the rules and terms used, to the payment of premiums, guarantee and indemnity amounts.
Ernesto Tzirulnik, president of the OAB-SP insurance and reinsurance law commission, and one of the project’s creators in 2004, says that, with the delay in the procedure, other countries took the lead, such as Portugal, Chile, Peru and Germany, that already have their special insurance contract laws in force since the end of the 2000s.
“Brazil is one of the last to have its special law on insurance contracts, despite having been one of the first to draw up a project”, said Tzirulnik.
Fenacor (National Federation of Insurance Brokers) also supports the resumption of the text. Armando Vergilio, president of the entity, was a federal deputy and even acted as rapporteur for the project in the Chamber.
“The final text approved in the House and sent to the Senate is the result of extensive debate, understanding and, finally, the consensus built and established between the parties”, said Vergilio.
