INSS writs: see who receives BRL 23 billion this month – 05/19/2023 – Market

The CJF (Council of Federal Justice) will release, until the end of this month, R$ 23.2 billion to pay the federal government’s precatories to citizens who defeated the Union in lawsuits in Justice. Most of this amount is intended for INSS (National Social Security Institute) retirees.

Precatories are legal debts above 60 minimum wages. The amount released annually involves the payment of funds to retirees and pensioners of Social Security and also to civil servants.

The letter communicating the total to be paid was sent by the CJF to the TRFs (Federal Regional Courts) earlier this month. In the message, the president of the body, Minister Maria Thereza de Assis Moura, communicates the value and says that she will send the money in May. However, there is no detail on how much will be allocated to the INSS. According to the agency, the final payment to policyholders will be made by June 15.

“The effective availability of the amounts in the beneficiaries’ account, in view of the internal administrative procedures in the courts and financial institutions, is expected to occur by the first half of June.”

This year, as well as in 2022, the payment of federal writs should follow what is determined in constitutional amendments 113 and 114, arising from the PEC (Proposed Amendment to the Constitution) of writs, which establishes rules for the discharge of debts, making that not all citizens receive.

Payment of prepayments will obey the following priority rule:

1. Precatories of a food nature whose holders or heirs are at least 60 years old or have a serious illness or people with disabilities, up to an amount equivalent to triple the amount established by law as RPV (Small Value Requirement)
2. Other precatories of a food nature up to an amount equivalent to three times the RPVs (180 minimum wages)
3. Other precatories that did not enter the first rules

When consulted, only two of the five TRFs in the country responded to the report by Sheet. The TRF-3 (Federal Regional Court of the 3rd Region), which serves the states of São Paulo and Mato Grosso do Sul, has already released its list of payments on its website trf3.jus.br. In this region, R$ 4.4 billion will be deposited to pay precatorios to 39.8 thousand beneficiaries. Of the total, R$ 3.953 billion are for social security actions, to settle the existing debt in 34.9 thousand INSS insured processes. The release of values ​​to policyholders is scheduled for the beginning of June.

In a note, the TRF-3 states that, “according to the budget limit defined by article 107-A of the Constitutional and Transitional Provisions Act (ADCT), it will not be possible to pay the totality of the writs registered in the budget proposals for 2022 and 2023 in the current exercise”. At TRF-4 (Federal Regional Court of the 4th Region), which serves the southern states of the country, the schedule includes financial transfers until May 20. The total to be paid is R$ 2.993 million plus monetary restatement between the date of issuance of the writ until the day of deposit, amounts not yet calculated.

The court informs that it still does not know the amount to be allocated to INSS insured persons or the number of closed cases that will be contemplated, including the number of beneficiaries. Policyholders must have the money released for withdrawal around June 15th.

WHO WILL RECEIVE PRECAUTIONS IN 2023?

The insured person who had the payment order issued by the judge between July 2, 2021 and April 2, 2022 enters the 2023 lot. Amounts released later will only be paid in 2024. it was done between July of one year and July of another.

Only those who have already won the lawsuit against the INSS, without the possibility of an appeal, have a chance of getting on the list of precatories, that is, with the process becoming final and unappealable. In addition, the value must be above 60 minimum wages.

For the year 2021, the limit value is BRL 66 thousand. For 2022, the payment limit is from BRL 72,720. To find out if you will receive it, the query must be made on the website of the court responsible for the location where the process was initiated.

How do I know if I will receive it?

It is possible to consult by the creditor’s CPF number, by the attorney’s OAB registration or by the court case number. It is necessary to check, in the “Procedure” field, what is written. If PRC appears, it means that the debt exceeds 60 minimum wages and is a precatory.

WHEN WILL THE PAYMENT BE

Payment depends on the date on which the federal courts receive the money from the CJF and the opening of accounts, a stage called processing, which can take up to a week. When the money is released, the credit is made in a public bank in the name of the beneficiary, either the insured person or his lawyer. It can be at Caixa Econômica Federal or at Banco do Brasil.
