INSS: Justice releases BRL 1.8 billion for retirees – 07/24/2023 – Market

The CJF (Federal Justice Council) released R$ 1.8 billion to pay the arrears of INSS (National Social Security Institute) retirees and pensioners who won a benefit granting or review action against the institute.

The amount will settle the RPVs (Small Value Requests), which are judicial debts of up to 60 minimum wages (today at R$ 79.2 thousand), in 84,091 cases with 109,403 beneficiaries. In order to receive it, the insured must have won the lawsuit without the possibility of an appeal, and the judge’s payment order must have been issued in June.

The total amount released by the CJF in July reached R$ 2.1 billion, and includes, in addition to social security debts, other food RPVs, such as salary differences for civil servants, for example. In all, amounts will be paid to 185.9 thousand beneficiaries who won 148.7 thousand cases.

The money is released to the TRF (Federal Regional Court) responsible for the process in the region where the insured person filed a lawsuit against the INSS. To find out if he will receive it, the retiree must consult the website of the TRF in his region.

In São Paulo and Mato Grosso do Sul, citizens can consult the TRF-3 (Regional Court of the 3rd Region) website: trf3.jus.br. It is also possible to call the cause’s lawyer, who will check to see if the amounts will be released in this lot. According to the court, the amounts have already been transferred and the processing of information has begun. The procedure should be finalized at the beginning of next week, with the opening of accounts, updating of the system and communication to the courts.

In the consultation, the retiree must inform his CPF or the OAB number of his lawyer. The insured can see the amount that will be deposited by Justice. Just go to a field that reads “Amount entered in the proposal”. This amount, however, may have corrections according to the date of payment.

The money falls into the account according to the release of the TRF, after a stage called processing, where accounts are opened at Banco do Brasil or Caixa Econômica Federal in the name of the retiree or his lawyer.

To find out if you are going to receive this batch, you must observe the month that appears in the “TRF protocol date” field. In July, policyholders whose arrears were cleared by the judge on some day in June are received in July. After payment, the information “total payment to the court” will appear.

RPV OR PRECATORY?

When checking your arrears on the website of the court in your region, you can find out whether you will receive RPV, which is paid within two months after the judge releases the amounts, or by precatório, released only once a year by the CJF.

For those who receive arrears of up to 60 minimum wages, the “Procedure” field will read “RPV”. If the value is greater, the same field will contain “PRC”.

WHO HAS THE RIGHT TO RECEIVE INSS DELAYS?

Insured persons who sued the INSS and won the action, with no possibility of appeal, are entitled to arrears. In addition, the money only comes out after the judge’s order to pay the amount. It is necessary that the process be of up to 60 minimum wages, as arrears with higher amounts become precatorios, which have a different payment system, with release in only one batch per year.
