Industries want postponement in eSocial – 06/21/2023 – Panel SA

The Federation of Industries of Minas Gerais (Fiemg) asked the Ministry of Labor to postpone until January 2024 the entry into force of the new filling of eSocial, a government system that condenses tax, social security and labor information from employees.

According to the entity, there are still public data that are not available, such as lawsuits and labor agreements.

The concern of the business community is that these possible gaps in filling generate penalties for companies.

Under the new rule, which will come into effect next month, companies must send employee information by the 15th of the month following the final decision of the labor lawsuit.

The rule also applies to the homologation of the judicial agreement, the homologation decision of the judgment settlement calculations or the conclusion of the agreement with the Preliminary Conciliation Commissions.

The federation asks that, in the impossibility of a new postponement, the folder suspend, until January, any penalties to companies that do not release data regarding the labor processes of employees.

They also want a test environment to be made available, along with the Federal Revenue Service, for companies to adapt to the new requirements.

The Ministry of Labor said that it has not yet defined what will be done and that it is aligning with other federal government bodies how to respond to Fiemg’s requests.
