The state tax in question is the Tax on the Circulation of Goods and Services (ICMS). Earlier this month, the National Committee of Finance Secretaries of the States and the Federal District (Comsefaz) decided to adopt a 17% rate for purchases made on online platforms of international retailers. Regarding the ordinance published this Friday, the rule applies exclusively to purchases made in e-commerce companies, national or foreign. The ordinance also establishes that the Special Secretariat of the Federal Revenue of Brazil make bimonthly reports to monitor the results obtained with the new rule, being able to propose changes in the established rate. Controversy in April In April, the Ministry of Finance and the Federal Revenue announced that they would extinguish the exemption for international trade between individuals worth up to US$ 50. At the time, the government explained that the exemption rule was being used in irregularly by international retailers, who “disguised” themselves as individuals to avoid paying taxes. Under current rules, international purchases made over the internet that exceed the quota may be taxed at 60% of the value of the invoice. A week after announcing the extinction of the exemption, the government went back and stated that it would not end the exemption for remittances between individuals. Despite the retreat, after the controversy, Shein assumed a commitment with the government for investments in Brazil. Exemption and taxation The combination of the exemption for purchases of up to US$ 50 with the creation of a fee for those who do not comply with the rules on international sales is part of the implementation of a government compliance plan with global e-commerces – mainly Chinese websites , like Shein. In May, the Minister of Finance, Fernando Haddad, said that the discussion on the rules for taxation on imports also involved the states, since they are entitled to charge ICMS on products purchased over the internet.
