Facebook owner obtains temporary decision that allows use of the Meta brand in Brazil

The São Paulo court granted an injunction that reversed the determination that prohibited the company from using the brand in the country. Judge Heraldo de Oliveira Silva reversed the determination made at the beginning of March by the São Paulo Court, in favor of the Brazilian company Meta Serviços em Informática. The decision met Meta Americana’s claim that the ban “could have a direct impact on the availability of its social networking services in the country”. Understand the case The Brazilian Meta took legal action because it understands that it has been harmed since Mark Zuckerberg’s company changed its name in October 2021. In the action, Meta Serviços em Informática said that it had more than 100 legal proceedings in which it appears as an improper defendant, because they should have been destined for the American company. In its previous decision, the São Paulo Court of Justice (TJ-SP) gave Meta Platforms 30 days to stop using the brand in the country and defined a daily fine of R$100,000 in case of non-compliance. Meta Serviços em Informática says that it was founded in 1990 and that it requested registration of the brand with the National Institute of Intellectual Property (INPI) in 1996, which was granted in 2008. The controller of Instagram, Facebook and WhatsApp was renamed Meta Platforms in October 28, 2021, amid a change in the company to bet on the so-called metaverse.
