Eletrobras suspends 353 dismissals after ruling by the Superior Labor Court

The company had laid off workers on August 31, but the TST decision suspended unapproved layoffs. Eletrobras must appeal the interruption of the layoff plan. Eletrobras informed this Monday (4th) that it suspended 353 dismissals after the Superior Labor Court (TST) determined the interruption of the company’s Voluntary Dismissal Plan (PDV). Last Friday (1st), Minister Alexandre Agra Belmonte, of the TST, decided to suspend, for 15 days, the PDV deadlines and all dismissals that were not approved. This prevents new adhesions and the continuity of dismissals already in progress. In a statement to the market this Monday (4), Eletrobras acknowledged the decision and said that “it is adopting the necessary measures to defend its interests”. According to the company, the 353 workers laid off on August 31 are being notified to return to their activities. These dismissals had not been ratified and, due to the TST decision, will be temporarily reversed. The current PDV is the company’s second after the privatization process. The plan was launched in June, and Eletrobras projects the dismissal of up to 1,574 employees. Until the last day, the 1st, the company had laid off 30% of the forecast, with 440 dismissals. “The dismissal decision was made after evaluating the criticality of the functions performed by the terminated workers and in full compliance with the safety of the Company’s operations, without compromising the adequate provision of the public service of transmission and generation granted to the Eletrobras companies”, said the company in the last Friday (1st). Eletrobras also stated that it would suspend, until December 2023, the dismissals of employees who operate electricity transmission plants or substations. The statement came after a letter from the Minister of Mines and Energy, Alexandre Silveira, asking for the suspension of the PDV until the ministry evaluates the company’s action plans for the provision of energy generation and transmission services in the coming years, considering the layoffs . “On the subject, it is relevant to mention the disturbance that occurred in the National Interconnected System – SIN on August 15, 2023, which removed approximately 1/3 of the electricity demand that was being supplied at the time”, wrote Silveira, referring to to the blackout on the 15th. The blackout originated in the Quixadá-Fortaleza II transmission line, of the São Francisco Hydroelectric Company (Chesf), a subsidiary of Eletrobras. Earlier, in July, Silveira had already shown concern about the company’s plan. At the time, he asked for information about Eletrobras’ planning to continue providing services amid layoffs. In justifying the determination to suspend the PDV, Agra Belmonte stated that Alexandre Silveira’s letter “explicitly demonstrates concern with the company’s action plans and shutdowns, given the risk of new blackouts or breakdowns in the system”. According to the TST minister, there was no record of a response from Eletrobras to the minister’s letter.
