Dispute between the Batista brothers and Paper goes to trial – 06/27/2023 – Panel SA

At the time he is disputing a vacancy at the STJ (Superior Court of Justice), the judge of the Court of Justice of São Paulo José Costa Netto is preparing to judge one of the most awaited cases in the fight between J&F and Paper Excellence for the command of Eldorado Cellulose.

Costa Netto is the rapporteur of an appeal by Paper which it withdrew after having generated a conflict of jurisdiction in the TJ-SP.

However, the judge did not approve the withdrawal, keeping the ongoing process under his tutelage so far.

The case may have a turnaround because the Special Group of the (TJ-SP) meets this Wednesday (28) to decide whether or not the case will remain in his hands. Formed by nine judges, the collegiate will discuss whether or not to accept the withdrawal of Paper’s appeal.

If so, the process will lose object. Other causes regarding the dispute between the two companies will remain in the TJ today under the umbrella of judge José Benedito Franco de Godoi.

Paper’s lawyers are interested in removing the case from Costa Netto’s office because they understand that he took measures that favored the rival.

This Wednesday’s trial has yet another element of pressure. The performance of the judge has been questioned by the president of the court, judge Ricardo Anafe, who saw evidence of abusive conduct in decisions taken by him in the process related to the two companies.

A Sheet was unable to contact Costa Netto this Tuesday (27).

Last month, Anafe opened a deadline for Costa Netto to present a preliminary defense regarding the alleged irregularities.

It is expected that, after analyzing the response, he will prepare a vote to be presented to the special body of the TJ, which will decide whether or not to open a disciplinary process against Costa Netto.
