Unecs (National Union of Commerce and Services Entities) asked Congress to overthrow the MP (provisional measure) that excludes ICMS from the calculation basis of contribution credits for PIS and Cofins.

For Unecs, which brings together associations such as Abrasel (bars and restaurants), Abras (supermarkets) and Abad (wholesalers and distributors of industrialized products), the government’s proposal creates a tax problem when it removes ICMS from its calculation base. highlighted in purchase invoices from suppliers.
The expectation of the Ministry of Finance is to collect R$ 30 billion with the tax adjustment announced by Haddad in the fiscal package in January. The measure is related to the judgment in the STF that removed ICMS from the PIS and Cofins calculation base in sales operations carried out by companies. According to the government, the problem is that the judgment did not include the acquisition of inputs by companies, which continued to consider ICMS in the calculation base of federal taxes in these operations because this was more advantageous —they have a greater tax credit to be deducted later .
Unecs disputes this view and states that the government’s objective is only “increasing PIS and Cofins collections, burdening services and goods sold and, consequently, the Brazilian population that, in the end, consumes such services and goods”.
Entities such as FecomercioSP and CACB have also positioned themselves against the MP, which expires in June, but starts to take effect at the turn of this month.
