Chamber approves changes to the legal framework for loan guarantees

The Chamber of Deputies approved this Tuesday (3) the so-called guarantees framework. The initiative reformulates the rules that regulate loan guarantees with the aim of reducing the risk of debtor default and, thus, reducing the cost of credit. Deputies accepted several Senate amendments to the project.

There were 305 votes in favor, 11 against and five abstentions. The proposal had already been approved by the Senate and will be sent for presidential approval. The plenary followed the opinion of the rapporteur, deputy João Maia (PL-RN), and accepted 37 of the 50 Senate amendments. The main change was the exclusion of the guarantee management service that the text approved last year by the Chamber created.

This service would manage these guarantees and their risk, register with the registry offices in the case of real estate, evaluate real and personal guarantees, sell the goods if the debt is executed and other services, informed the Chamber Agency. On the other hand, one of the amendments creates the possibility of using extrajudicial measures to recover credit through notary offices, allowing the creditor to make a discount proposal through protest notary offices. The rapporteur also accepted the restoration of the Caixa Econômica Federal monopoly to seize movable assets such as jewelry, silverware, among others.
