Casas Bahia: Klein brothers dispute inventory in court – 7/5/2023 – Panel SA

Businessman Saul Klein, one of the heirs of Casas Bahia, asked the 4th Civil Court of São Caetano do Sul (SP) that his older brother, Michael Klein, be removed from the command of the inventory of his father, Samuel Klein, founder of the retail chain who died at the end of 2014.
In the request, made this Tuesday (4), Saul’s defense states that Michael is being investigated in a police investigation that investigates a possible crime of embezzlement.
In this case, the Justice investigates indications that Samuel Klein’s signatures would have been forged in Casas Bahia documents and in the will.
The defense claims that one of these signatures, which were allegedly false, was used to transfer control of the retail chain to Michael, making Samuel (founder) a minority shareholder.
Saul claims that Michael refused to provide clarification, claiming to protect the interests of the estate.
One of these points involves proof of an alleged payment to Samuel of R$377 million for the purchase of his stake in Casas Bahia.
The defense maintains that, in addition to this document containing an allegedly false signature, Michael did not actually prove the payment, even with extrajudicial requests.
He also failed to present documents involving the inventoried assets and estate rights.
“Thus, under penalty of allowing the perpetuation of acts that can be recognized as null and compromising the regular outcome of the inventory, the preliminary removal of the defendant from the position of administrator is a necessary measure”, asks the defense in the process.
