Rio de Janeiro Court accepted request from the Public Ministry
The Rio de Janeiro Court accepted the Public Ministry’s request and actor Bruno de Luca will respond for failure to help, after allegedly failing to help fellow actor Kayky Brito during a run over in Barra da Tijuca.
In September, Kayky Brito was seriously run over, was rescued by the driver and hospitalized in serious condition. Minutes before the accident, he was at a kiosk with Bruno de Luca, who left the place without providing any assistance to his friend.
The report, however, contradicts images recorded by security cameras and statements from people present at the scene. Witnesses said Bruno was warned about the accident and who the victim was before fleeing through the sand on the beach.
In the request, the MP says: “[De Luca] He was the only one who left the scene immediately after the accident, without taking any action to provide assistance, not even knowing that any assistance or request had been made.”
Bruno de Luca’s advisors and the actor’s lawyer, Rodrigo Brocchi, spoke out in a note.
“Bruno De Luca did not commit the crime of failing to provide assistance. There is no crime of failure to provide assistance if anyone close to the accident provides assistance to the victim. Bruno was not the cause of the accident, he has a specific obligation to provide assistance, as in fact he did, and he does not perform any function that gives him a legal obligation to provide assistance regardless of whether third parties have already done so. If that were the case, everyone present who was not the person to call the firefighters would have failed to provide assistance,” the statement states.
Bruno de Luca cannot respond, says lawyer
Earlier, Rodrigo Brocchi’s team, responsible for defending Bruno de Luca, told Estadão that the actor could not be accused of failing to provide assistance in the episode where Kayky Brito was run over.
“At no point can Bruno de Luca be accused of failing to provide assistance, as several people were already providing the necessary assistance, including calling the firefighters. Bruno provided all the clarifications, for no other reason it was concluded that there was no improper act”,
said the actor’s defense via email.
