Applications: Lula creates group to discuss regulation – 05/01/2023 – Market

The Luiz Inácio Lula da Silva (PT) government set up this Monday (1st) a working group to discuss the regulation of activities by delivery and transport apps, such as iFood, Uber, 99 and others. The decree was published in an extra edition of the DOU (Official Gazette).

According to the text, it is up to the group to formulate proposals to “regulate the activities of providing services, transporting goods, transporting people and other activities carried out through technological platforms”, in addition to the normative acts necessary for the implementation of these activities.

The collegiate will be composed of 45 members divided into three groups, 15 of which are workers’ representatives – all members of trade union centrals. For spokespersons for the applications, this composition raises questions about the legitimacy of the discussions, since there would be no direct representatives of the couriers.

According to the decree, the workers will be represented by 2 members of the CSB (Central of Brazilian Unions), 2 of the CTB (Central of Workers and Workers of Brazil), 3 of the CUT (Central Única dos Trabalhadores), 3 of the FS (Força Union), 2 from the NCST (New Union Central of Workers) and 3 from the UGT (General Union of Workers).

On the government side, there will be 15 members from nine bodies, including 4 from the Ministry of Labor and Employment, the folder in charge of coordinating the works. The working group is completed by 15 representatives of employers, including members of Amobitec (Brazilian Association of Mobility and Technology), which brings together the main companies in the sector.

Specialized technical groups may also be set up with the aim of carrying out information surveys and preparing studies to support the discussions.

The working group will have a duration of 150 days, which may be extended once for the same period, by means of an act by the Minister of Labor and Employment, Luiz Marinho.

We want app workers to have social security, says Lula on May 1st

This Monday, Labor Day, in a unified act of union centrals in the Anhangabaú valley (central region of the capital of São Paulo), Lula spoke about the regulation for application workers.

The president stated that he intends to respect the fact that many workers want to remain self-employed, without a CLT bond, but there will be a way to guarantee social security protection to the category.

“Many times the guy doesn’t want to sign the card, that’s no problem. But what we want is for the person who works with the app to have a social security commitment, because if he gets sick, he has to have coverage.”

A SheetMarinho stated that the goal of the Ministry of Labor is to discuss the regulation of applications in the first half of the year.

“We want technological innovation to bring benefits to society, not harm. We were just now in Spain and the model is interesting. The Colombian model, if approved, is better,” he said.
