Aneel fines Enel R$165 million for blackout in São Paulo

The National Electric Energy Agency (Aneel) imposed this Thursday (15) a fine of R$ 165.8 million on the distributor Enel for cause of the blackout in São Paulo, in November 2023. Enel serves 8.2 million consumers in the capital and in another 38 municipalities. Enel has 10 days to appeal the fine, starting this Thursday (15). Payment must be made within 20 days. In November, Aneel’s general director, Sandoval Feitosa, stated that the agency would investigate seven distributors in the state. In addition to Enel, six other distributors operate in the state and had their networks affected: CPFL Santa Cruz, CPFL Paulista, CPFL Piratininga, Elektro, Energisa Sul-Sudeste and EDP. In a statement, Aneel stated that it “undertook several actions to improve the provision of distribution services in the face of constant and increasingly intense highly severe weather events”. Enel had already been fined the same amount last week, R$165.8 million, for “providing inadequate service” over the last two years. Request to the TCU At the end of January, the mayor of São Paulo, Ricardo Nunes (MDB), was in Brasília and delivered a letter to the minister of the Federal Court of Auditors (TCU), Bruno Dantas, requesting action to monitor the contract of energy supply by Enel, after supply problems. In this letter, Nunes also asked that the Court not propose the renewal of the concession and, if Enel’s responsibility for the successive problems in the capital is confirmed, demand the termination of the contract.
