Exposing and recording intimate images without authorization became a crime in the Penal Code from the end of 2018. There are two crimes: Rose Leonel law or 13.772/2018, punishes unauthorized recording, including montages; law 13.718/18, penalizes the disclosure of rape and sex scenes or pornography without the consent of the victim; Law 13.772/2018: Amends the Penal Code, with article 216-B, which deals with the Unauthorized Registration of Sexual Intimacy, which may lead to imprisonment from 6 months to 1 year and a fine. Regarding the exposure of images, there is Law 13.718/18, which is included in article 218-C of the Penal Code, which says that exposing intimate images of third parties can lead to 1 to 5 years in prison, in addition to compensation for moral and material damages the victim. Considering that the conduct is motivated by revenge or humiliation, or that the person who committed it maintains or maintained an “intimate relationship of affection” with the victim, the penalty can be increased by up to two thirds, explains Judge Wagner Cinelli. The penalty can increase even more if the images were shared by a guardian, stepfather or any other title that justice considers “authoritative” over the victim.
