Telephone operators are preparing lawsuits questioning the public notice for Internet Brasil, a federal program that provides for the connection of 700,000 schools to 4G internet through so-called neutral chips.
The telecoms claim that, by virtue of a precautionary measure by Base Mobile with Anatel (National Telecommunications Agency), they are being forced to supply the chips in a situation that, according to them, violates the sector’s legislation.
This imbroglio started in March, when Base Mobile won the bid.
To provide the service, the company sought Vivo and Claro to obtain around 650,000 chips that, in fact, have a code inside (with different numbers) capable of operating on the network of any operator. Tim didn’t answer the company because it appealed to Justice.
Based on this chip offered by telecoms, Base Mobile has developed a system that controls access to internet content.
The problem for telecoms is simple: the sector’s legislation does not provide for the sale of an input of this type to a company that is not regulated.
It would be the same as Netflix, for example, offering 5G without being a telecommunications operator.
The commercialization of neutral chips for Base Telecom could only occur if there was a network sharing agreement (virtual operation, for example) or if it were another operator, which is not the case.
Base Mobile claims to be a company that provides Value Added Service, a category that is not subject to industry regulation —like internet providers.
For the telecoms, in practice, this means that, if any crime is committed and it is linked to this chip, any type of tracking will be impossible, for example.
Therefore, they are already evaluating legal measures so that they can refuse to negotiate with Base Mobile.
