TV Globo/ Reproduction The Federal Audit Court (TCU) found evidence of undue payments of more than R$1 billion in unemployment insurance among 2018 and 2022, under the management of former presidents Michel Temer and Jair Bolsonaro. The irregularities range from the payment of more installments than due to the granting of benefits to public servants. Unemployment insurance is granted for a maximum period of 3 to 5 months, depending on the contribution period and the number of times the worker is fired. Most of the benefits granted beyond what is expected are for the first license, that is, when the candidate will receive insurance for the first time. The situations considered irregular by the TCU are people who would have worked less than 12 months in the last three years and who received three installments of unemployment insurance. “In other words, he would not be entitled to any benefit, but he still received three installments”, says the technical area. To the Court, the Ministry of Labor stated that the audit findings were caused by inconsistencies in the database used by TCU inspectors. The folder claims that it was not the same basis used for payments. “Obviously, the analysis allows us to state that there are inconsistencies between the databases, but it does not allow us to conclude that there are no irregularities in payments”, says the report. Payments to public employees The Court of Auditors also found evidence of irregular payments to public administration employees, who are not entitled to unemployment insurance. Payments total R$146.97 million in the period from 2018 to 2022. In total, 29,535 employees benefited. “In the analysis of the sample carried out by the TCU, it was found that all the cases analyzed were possibly irregular, as the beneficiaries are employees of city halls and federal states. No case was found in which the receipt of the benefit was justified”, writes the technical area . How to apply for unemployment insurance? Fraudulent employment contracts The audit also found irregularities in the granting of benefits to employment contracts with signs of fraud. In this sense, it is considered a presumption of fraud when the worker is terminated and then rehired or remains in service even after 90 days of dismissal. For this analysis, the TCU extended the inspected horizon to 2014 to 2022. During this period, R$544,000 were unduly paid for contracts with signs of fraud. “It should be noted that, in reality, the cases must be much more frequent than those found”, says the document. The TCU only analyzed recurring requests, without considering other employment databases. TCU Recommendations In judgment this Wednesday (31), the TCU ministers decided to order the Ministry of Labor to, within 90 days, adopt the following measures: regularize overpayments; ensure that the contract signed with DataPrev has mechanisms for holding the company responsible in the event of a serious error that could cause losses to public accounts; ensure means of monitoring the granting of the benefit. The court also made some recommendations, such as continuous and systematic evaluation of the outcome of administrative appeals, obtaining data from court sentences.
