Tax reform: Fiesp wants taxation of digital sales – 05/15/2023 – What is this tax

Fiesp (Federation of Industries of the State of São Paulo) defends the creation of a management committee for the new tax on consumption that will be created from the tax reform, with representatives from the public and private sectors. According to the entity, the objective is to avoid an increase in the tax burden.

Therefore, the new tax should be limited to 25%, an estimated value to replace the current collection of the five taxes affected by the reform (PIS, Cofins, IPI, ICMS and ISS).

In a note supporting the reform released this Monday (15), Fiesp also defends mechanisms to tax digital sales, both direct and through marketplaces, so that there is equal competition between physical and digital markets and between national and international products. imported.

The entity also proposes that, until the reform is approved, as an immediate alternative to stimulate the sector, two measures be adopted: the extension of deadlines for payment of federal and state taxes and the immediate depreciation of assets.

“The measure would generate an immediate financial gain for the companies that, in this way, would have resources released to make investments. The United States has already adopted similar measures several times in the past decades as a way to stimulate the economy”, says the Fiesp.

Other points defended by the entity are the optional adhesion to the new tax by Simples Nacional companies, the guarantee that all goods and services acquired for production will generate immediate credit and the complete exemption of investments and exports, points that must be contemplated in the proposal that is being elaborated by a working group of the Chamber.

In addition, the entity requests that the transition to the new system be quick, while respecting tax incentives with a fixed term and existing contracts, especially with the public sector.

Fiesp also says that systems of tax substitution and single-phase incidence (payment of taxes at the beginning of the production chain) should be eliminated, keeping only justified exceptions after the impossibility of effective inspection.
