STF releases payment of nursing floor in the public sector

The Federal Supreme Court (STF) decided this Friday (30) for the constitutionality of the salary floor for nursing professionals, including in the public sector. The magistrates, however, imposed conditions for the application of the law, approved last year by Congress.
Among these rules, it was defined that the payment of the floor to professionals working in the state health system and philanthropic entities that serve more than 60% of SUS patients will depend on the full transfer of complementary resources from the Union. The payment of the floor proportional to the journey was also admitted.
For the payment of the floor to professionals working in private entities, six ministers understood that there must be prior union negotiation within 60 days, counted from the publication of the judgment of the STF decision.
However, ministers differed in relation to the need for regionalization of the nursing salary floor. Four ministers (Dias Toffoli, Alexandre de Moraes, Luiz Fux and Nunes Marques) voted in favor of regionalization, while two (Edson Fachin and Rosa Weber) supported the universal and immediate application of the floor.
The value of the national nursing floor, approved by Congress, is BRL 4,750 for nurses, BRL 3,325 for technicians and BRL 2,375 for nursing assistants and midwives.
