The Senate approved this Wednesday (10) a complementary bill that regulates special retirement due to dangerous work. The text (PLP 245/2019), by Senator Eduardo Braga (MDB-AM), establishes access criteria for insured persons of the General Social Security System (RGPS) exposed to agents harmful to health or at risk due to the danger inherent in the profession. The issue had been pending since the 2019 pension reform.

The proposal, which received the favorable vote of 66 senators and no votes against or abstention, goes to the Chamber of Deputies. According to PLP 245/2019, the insured person with effective exposure to harmful chemical, physical and biological agents harmful to health, included in a list defined by the Executive Branch, is entitled to special retirement, reported Agência Senado.

According to the text, a grace period of 180 months of contributions must be observed. Requirements differ for policyholders who joined the RGPS before the Social Security reform and for those who joined afterwards. For affiliates before the reform, there are three possibilities, within the points system. The first is the sum of age and contribution time of 66 points, with 15 years of effective exposure. The second is the sum of 76 points with 20 years of effective exposure. The third is the sum of 86 points with 25 years of effective exposure.

For members after the reform, there is no points system, but minimum age rules. The first is 55 years old, with 15 years of effective exposure. The second is 58 years old, with 20 years of effective exposure. The third is 60 years old, with 25 years of effective exposure. The article establishes the company’s obligation to readjust these professionals, with job stability, after the maximum time of exposure to harmful agents. The text also provides for fines for companies that do not keep up-to-date records of activities.
