Public lawyers criticize Carf agreement – 02/20/2023 – Panel SA

Anafe (National Association of Federal Public Lawyers) sent to the STF on Friday (17) a request to join, as an interested party, in the action filed by the OAB (Order of Lawyers of Brazil) regarding the casting vote in the CARF (Administrative Council of Fiscal Resources).
The government is discussing an agreement that could end the ADI (Direct Action of Unconstitutionality) brought by the OAB. In the request for entry as amicus curiae, Anafe criticizes the agreement that has been sewn between the government and large companies.
The agreement provides that, in cases of judgment favorable to the National Treasury concluded by the casting vote, interest will be excluded and there will be no charge, which bothered the public lawyers.
According to Anafe, the proposal ignores the legal provision that part of the charge belongs to federal public lawyers in legal fees.
