The Lula government issued Provisional Measure (MP) 1161/23, which gives the President of the Republic the power to define, by decree, the composition of the Board of the Investment Partnership Program (PPI). Until then, council members were chosen by a collegiate of ministers. The MP amends Law 13,334/16, which created the PPI, informed Agência Câmara.

The text was published in an extra edition of the Official Gazette (DOU) on Friday (10). The provisional measure removes from the text of the PPI law the list of council members, which already included, in addition to ministers, presidents of BNDES, Caixa and Banco do Brasil. In its place, the government edited a decree with the new composition of the CPPI, which will be formed by nine people, all Ministers of State, with the President of the Civil House.

In the statement of reasons accompanying the MP, the Minister of Management and Innovation in Public Services, Esther Dweck, and the Minister of the Civil House, Rui Costa, claim that the change brings “greater flexibility in subsequent changes” by the council. Launched during the Temer government, the PPI aims to expand partnership contracts with the private sector and the privatization of state-owned companies. The council is responsible for advising the President of the Republic on decisions about the program, defining priorities and monitoring the execution of actions.

MP 1161/23 also revokes some provisions of Provisional Measure 1154/23, which deals with the administrative structure of the Lula government. The objective is to put an end to the duplication of attributions between the ministries of Integration and Regional Development (MIDR) and of the Environment and Climate Change (MMA).

Thus, MP 1161/23 makes it clear that the National Water Resources Policy is a function of the MMA, which is linked to the National Water and Basic Sanitation Agency (ANA). The new MP will be analyzed by the plenary sessions of the Chamber of Deputies and the Federal Senate.
