An assessment released this week by Procon de João Pessoa to iFood for charging minimum consumption on purchases made through the app should open a new front of discord with the national Abrasel (association of bars and restaurants).
Paulo Solmucci, President of Abrasel, says that he celebrates the measure by Procon because it can help clarify the cost of shipping to the market. “The Brazilian consumer is very much in that idea of free delivery, that is, he believes that he is not paying for shipping when he receives a single price, but there is no such thing as free shipping, and the sector needs to provide transparency”, he says.
iFood, in turn, says that there is no express determination or prohibition on setting a minimum price for placing orders through intermediation platforms, such as delivery apps, “the argument of practical of tying sales on the platform”, according to the company.
“The practice of the minimum order has just cause, being adopted so that there is economic balance between the parties involved in the operation: partner establishments, consumers, independent couriers and iFood, aiming at not prejudice to any of the parties”, says the company.
Procon points to married sales and says that the practice “infringes the consumer’s freedom of choice resulting from the imposition of a secondary product or service to gain access to the main product”. According to the agency, the fine can reach R$ 3 million.
iFood claims it was not notified, but says it is available to provide clarification to the agency.
