Until April, the Treasury paid only one third of what was foreseen by the Budget Law with precatorios, Union debt securities with final court rulings.
According to the Budget Execution Report of the Ministry of Finance, the government should transfer R$ 24 billion throughout the year (R$ 2 billion, on average, per month).
However, until April R$ 2 billion were paid in total – R$ 500 thousand on average per month. The queue of precatories, however, is large and far exceeds this amount.
Transfers with precatories remain dammed amid the lack of definition by the federal government for the regulation of the use of these titles, considered by Justice liquid and certain.
Even so, still according to the report, there was a reduction in the stock of precatorios by R$ 2 billion between January and April.
The value represents the amount that was considered as a reduction factor for the Union’s consolidated debt.
The Union’s stock of precatories is R$ 143 billion. That is, only 1.4% of this amount was deducted by the Union in the first four months of this year in relation to the stock of precatories and small-value requisitions.
A constitutional amendment enacted by Congress in 2021 allowed the use of these bonds as currency in operations with the Union. The rule is self-applicable, according to the text of the Magna Carta.
The issue, however, became an imbroglio for the government. Decisions by the AGU (Attorney General of the Union) suspended the analysis of processes of this nature until new rules are published with the procedures to be followed by the various public bodies.
The PEC approved by the Jair Bolsonaro government created a snowball for the government. Even if the Union pays the R$ 24 billion in writs this year, the stock would remain above R$ 118 billion.
