Tax Enforcement Attorney expects to hold four more auctions in the next two months
The State Attorney General’s Office (PGE-AM), through the Tax Enforcement Attorney’s Office (PROEF), will recover more than R$ 11 million for the State Government’s coffers resulting from auctions of four properties arising from attachments in Tax Foreclosure proceedings , carried out between October 2022 and February 2023.
According to the head of PROEF, attorney Kalina Cohen, the expectation is that four more real estate auctions will take place, between March and April this year, whose summed values exceed R$ 12 million.
Auctions by the State Active Debt Court were suspended in 2020 due to the Covid-19 pandemic, and took place again in October last year.
“We were going to start a series of auctions in 2020, we had a place scheduled for April, but the pandemic frustrated our plans. Real estate valuations ended up being outdated and due to the restrictions on issuing warrants, we were prevented from revaluing the assets”, explains Kalina Cohen.
The return occurred with the support of technology and the holding of auctions online, which has generated very positive responses, according to the head of PROEF.
“The virtual auction has been a very powerful tool, because today everything is online, allowing for greater competition between bidders. All auctions are carried out through the Tax Enforcement Court and the auctioneer chosen by the court. It is a transparent, efficient and secure process for all parties”, he points out.
“People enter the auction site, register and, on the day and time set in the public notice, enter the virtual room and offer their bids. Everything is very dynamic”, he adds.
Collection
The PGE-AM Tax Enforcement Office is responsible for executing debts entered in active debt of a tax and non-tax nature. There are several ways of acting in these judicial proceedings in order to recover the State’s credits, such as the blocking of values existing in the name of the Debtor or the constriction of movable, immovable, rights, etc.
“There are debtors who have not paid their taxes due to some financial difficulty in their business. But there are many executed who squander their assets to not honor their duties with the Tax Authorities. And our main focus today is precisely this debtor who seeks to hide his assets in order not to pay taxes and practice unfair competition with the good taxpayer”, emphasizes Kalina.
“The work of the Fiscal Executions Attorney’s Office is to collect amounts not paid spontaneously by the taxpayer, allowing the State of Amazonas to put into practice its public policies necessary for the population, and, at the same time, protect the good paying taxpayer”, completes the attorney .
