Pão de Açúcar is the most sued in labor court – 01/25/2023 – Mônica Bergamo

Grupo Pão de Açúcar, Fundação Casa and Banco Santander were the most sued companies in 2022 at the Regional Labor Court of the 2nd Region (TRT-2). The court is considered the largest labor court in the country and encompasses the capital of São Paulo, the Metropolitan Region of São Paulo and Baixada Santista.

RANKING

Pão de Açúcar concentrated the largest number of lawsuits. There were 8,526 throughout last year, in causes that add up to a total value of R$ 1.15 billion. Fundação Casa comes next, with 4,624 actions totaling R$ 146 million. Banco Santander is in third place, with 4,524 processes and a value of R$ 757 million, higher than the second place.

Data are from TRT-2 and refer to processes that are being processed in the first instance. The indicated value covers the claims for damages presented in the actions, and not the convictions.

Sought by the column, Grupo Pão de Açúcar says it will not comment. Banco Santander did not respond at the time of publication of this text.

LIVING EYE

Fundação Casa, in turn, claims that the increase in the number of labor complaints is related to requests for additional unhealthy conditions, and that the institution’s legal advice has already filed appeals. “The TST itself established the thesis, in 2022, that Fundação Casa’s socio-educational support agents are not entitled to the additional benefit due to the location where the service is provided”, he says.

The number of lawsuits involving Pão de Açúcar increased by 70% from 2021 to 2022, rising from 5,007 to 8,526. That year, the company was also the leader of labor lawsuits in TRT-2.

In the case of Santander, there was also an increase, but smaller, of 36% – there were 3,336 shares in 2021, compared to 4,524 last year.

COMPARISON

As for Fundação Casa, it is not possible to make this comparison, because the entity does not appear in the list of the five most complained companies of the TRT-2 of 2021. That year, the municipality of São Paulo had 4,864 actions, which placed it in second position among the companies with the most lawsuits in court. In 2022, the number of shares in the municipality of São Paulo was slightly lower, 4,019.
