OAB paralyzes SP agreement that pays precatory with discount – 07/04/2023 – Panel SA

The OAB-SP managed to paralyze in court the effects of the agreements of the city of São Paulo that, in practice, cause damage to taxpayers.

The entity obtained an injunction from the 15th Public Treasury Court of São Paulo to prevent the city hall from forcing those who have already entered into agreements for the receipt of precatories to give up other ongoing actions.

Precatories are government debt securities with final court rulings.

In the case of São Paulo, the agreement initially involved 1,900 judged cases, which, together, reached a total of R$ 552 million.

At this moment, there is another round of negotiations with another 4,000 agreements. The city hall proposes discounts of up to 40% for making the payment.

The municipality’s total debt with precatorios is R$ 1.5 billion, according to data from the Municipal Court of Auditors. The amount, however, should double with the addition of interest.

The OAB-SP went to court against these agreements, considering that they have unconstitutional clauses that lead to a deviation from the purpose: the full payment of precatories.

The Public Prosecutor’s Office of São Paulo was in favor of the OAB’s request, claiming that there could be damage to the parties, if the agreements are considered outside the constitutional limits in the future.
