Nursing floor: judgment is suspended – 06/16/2023 – Market

Minister Dias Toffoli, of the STF (Supreme Federal Court), requested a review and suspended this Friday (16) the virtual trial of the process that discusses the implementation of the national nursing floor.
So far, ministers Luís Roberto Barroso and Gilmar Mendes have given a joint vote which, among other initiatives, provides that the implementation of the floor in the private network “should be preceded by collective negotiations between the parties, as an essential procedural requirement, taking into account concern about mass layoffs or damage to health services”.
According to the joint vote, if there is no agreement within a period of 60 days, the rules laid down in last year’s law that instituted the floor will apply.
The norm approved by Congress establishes a salary floor of R$ 4,750 for nurses; 70% of this amount to nursing technicians; and 50% for auxiliary nurses and midwives, both in the public and private sectors.
The only dissenting vote, so far, is from Minister Edson Fachin, in favor of the immediate adoption of the rules provided for in the floor law without any type of restriction.
