MP asks for blockage of R$ 20 million from 123milhas and return of amounts to customers

The Public Ministry of Minas Gerais (MPMG) asked the Justice this Tuesday (29) to block R$ 20 million from 123milhas and its partners. The action was filed through the Public Prosecutor’s Office for the Defense of the Citizen of Uberlândia “with a view to future compensation to consumers”. The MP also asked for the company to be ordered to pay moral damages in the amount of R$ 10 million, in addition to the payment of individual damages to customers injured by the suspension of promotional airfare packages.
The MP also requested that 123milhas be prohibited from carrying out so-called “flexible promotions”, with open dates, “in order to avoid further damage and new victims”. According to the Public Prosecutor’s Office, “123milhas’ conduct led consumers to be harmed: first, it advertises the low cost of the package; for this purpose, it uses aggressive marketing, including sertanejo singers and soap opera actors; explores the inexperience of consumers with the idea that it is possible to sell airline tickets at the advertised price in such a volatile market”.
“In a second moment, after signing the contract: he does not fulfill the offer; transfers the risk to the consumer; fixes obstacle to return the amount received; it makes customer service difficult”, added the MP, in a note. Uberlândia Public Prosecutor Fernando Martins, responsible for the action, considered 123milhas’ action “a real trap”. “We see, therefore, the breach of trust on the part of the company”, he wrote in the action.
Earlier, the travel agency filed a request for judicial recovery at the Court of Justice of Minas Gerais. The value of the cause is more than R$ 2 billion. The company stated that “the measure aims to ensure compliance with the commitments assumed with customers, former employees and suppliers”.
