Minha Casa Minha Vida: Anatel wants to block solar energy – 06/20/2023 – Market

Aneel (National Electric Energy Agency) asked for the veto of the articles approved in the MP (Provisional Measure) of Minha Casa Minha Vida, providing for the installation of photovoltaic panels in the housing units of the program.

The text approved in Congress provides for a discount on the amounts charged to beneficiaries of the housing program and the compulsory purchase of excess energy generated in homes.

The measure was included in the text at the request of the chairman of the joint committee that analyzed the MP, Senator Eduardo Braga (MDB-AM), found the Sheet. Braga did not respond to questions.

The parliamentarian insisted that the benefits be maintained in a meeting held on the morning of the day the MP was approved in the commission, according to two sources who were at the scene.

The purpose of the measures is to lower the electricity bill for residents of Minha Casa Minha Vida residential, thus favoring the maintenance of families in the premises.

According to Aneel, the discount for beneficiaries to be able to connect the solar panels to the grid will cost R$ 429.5 million. Another R$663.24 million comes from the compulsory purchase of excess energy generated by the units.

The impact of R$ 1 billion, predicts Aneel, will be “supported by other consumers via tariff increases”. The assessment is in a document sent by the regulatory agency to the Ministry of Mines and Energy requesting a veto.

In addition to pointing out the impact on the electricity bill, Aneel also said that the measure “can be understood as unconstitutional, as it deals with matters of thematic content that are foreign to the original object of the aforementioned Provisional Measure”.

The measure was also considered inappropriate by the agency “for not being accompanied by the respective estimate of the financial/tariff impact”.

The MP approved by the National Congress is under analysis by the federal government, which is evaluating what will be vetoed. In this process, the various ministries involved in the matter send their positions to the Civil House.

The Lula government (PT) has already committed to vetoing a device that obliges the contracting of housing insurance. The assessment in the Senate is that the insurance makes the property more expensive and can be waived because there is already a guarantee from the builders for a period of five years.

The change cannot be made in the house because the text was approved by the Senate on the last day of the MP’s deadline. Any changes would send the bill back to the Chamber of Deputies.

The provisional measure was unanimously approved by the mixed commission (made up of deputies and senators) that analyzed the issue in the National Congress on the 1st.

Approved report brought other changes

The report by federal deputy Fernando Marangoni (União-SP) in the joint commission changed many points of the original proposal and included a series of novelties. While the text sent by the government had 16 pages, the replacement was approved with 49.

Among the novelties approved by Congress are the readjustment in the value of works after they start, following inflation. Before, the amount was not corrected, which in the view of parliamentarians led builders to abandon undertakings.

Another innovation is encouraging the production of units closer to urban centers with urban infrastructure in the surroundings.

The approved text also included the need for 5% of Minha Casa Minha Vida resources to be allocated to idle works, retrofits and developments in cities with less than 50,000 inhabitants to states and municipalities.
