Madero no longer needs to prove that he really has the best burger in the world. The statement, which is part of the network’s advertising, was challenged in court by Burger King. The fast-food chain in the United States was questioning Madero in court for unfair competition and customer diversion due to this advertising. In trial on Tuesday (21), the 3rd Panel of the Superior Court of Justice ruled in favor of Madero, who now no longer needs to prove through expertise that he is telling the truth.

In the first instance decision of the case, which has been running in court since 2016, the judge determined Madero’s obligation to prove that he has the best hamburger in the world. To this end, the judge requested that an expert be carried out to prove the superior quality of Junior Durski’s hamburger.

On appeal, at the São Paulo Court of Justice, the Curitiba network had already managed to reverse the initial decision. At the time, the state court dismissed the application of the Consumer Protection Code and pointed out that the reversal of the burden of proof would be undue, since the two parties would have the same difficulty in proving the allegation.

Burger King, in turn, did not give up the legal dispute and took the case to the STJ. But the court’s rapporteur, Minister Paulo de Tarso Sanseverino, dismissed Burger King’s special appeal.

With that, now who will have to prove that Madero doesn’t have the best burger in the world is Burger King. According to information on the Legal Consultant website, the costs of the expertise should be divided between the parties.
