The rapporteur of the Budget Guidelines Law (LDO) project, Danilo Forte (União-CE), said this Tuesday (7), during the vote on the preliminary opinion of the proposal, that he intends to create a new type of parliamentary amendment, this intended for Congressional party benches. Currently, there are three types of amendments: individual, intended for each parliamentarian; from a state bench, with nomination made by deputies and senators from the same state and from a commission, with resources indicated by thematic panels in Congress. “We are creating a new space, a new heading, a new title which is RP5, which will house the part of the Budget that will be allocated to parliamentary amendments by bench. It is a new initiative in which representation benches will have a role in influencing the country’s budget construction,” he stated. Vinicius Loures/Chamber of Deputies The creation of this new resource is a demand from parliamentarians since the rapporteur’s amendments, which became known as the “secret budget” due to the lack of transparency and criteria for their distribution, were considered unconstitutional by the Federal Supreme Court (STF) at the end of 2022. In their place, a type of “informal” amendment was created, managed by the Executive but which, in practice, was indicated by parliamentarians. Deputies and senators, however, have criticized the government’s delay in releasing this type of resource. “In the same way that there is the individual amendment, the bench amendment by state, we will also have the bench amendment by party, which is very important to democratize these parties’ access to the budget and provide more transparency to budget execution.” Indefinite imposition The rapporteur did not confirm whether this new parliamentary amendment will also be mandatory – that is, mandatory payment by the Executive, as bench and individual amendments are today. According to the deputy, this will still be defined with parliamentarians. Danilo Forte also did not say what the proportion of these resources will be within the Budget. The idea is that amendments from party benches are divided according to the size of the acronyms. In other words, parties with greater representation in Congress will have a greater share of the resources. The internal division within the acronyms – how much will be nominated by each parliamentarian – will be up to each party. “Each bench will have its own criteria and internal discussion,” said Forte. “I hope it is as equitable as possible”, said the deputy. Danilo Forte is also studying presenting a schedule for mandatory payment by the government of the mandatory amendments. The idea is that the Executive is obliged to pay the resources within a period determined by Congress. Today , despite being mandatory, the government can choose when to pay these resources — and, in general, it uses this power to make payments on the eve of important votes. For this reason, the creation of a payment schedule is criticized by the government .
