Lava Jato: former PT marketers lose appeal at Carf – 02/14/2023 – Panel SA

While large companies are trying to reach an agreement to soften the impact of the resumption of the casting vote in Carf (Administrative Council of Tax Appeals), João Santana and Mônica Moura, former PT marketers involved in Operation Lava Jato, had an appeal denied in the Council In this month.

The couple was fined by the Federal Revenue after investigations pointed to the evasion of payments received in the 2014 elections, a period in which Santana acted in the campaign of former president Dilma Rousseff (PT).

The fines against Polis Propaganda e Marketing, their company, exceed R$ 21 million and involve taxes such as Corporate Income Tax, CSLL (Social Contribution on Net Income), PIS and Cofins.

According to the minutes of the judgment meeting, published on Tuesday (14), the members of the 1st panel of the Superior Chamber of CARF unanimously voted against the Polis appeal. The case had been running in the body since 2019 and entered the agenda of the sessions scheduled after the Lula government edited the provisional measure that reestablished the casting vote in the Council.

The device returns to the government the tie-breaking vote in the dispute with the Federal Revenue Service.

At the end of last month, the couple filed a writ of mandamus in court trying to prevent the trial at Carf. The allegation was that the return of the casting vote is unfair. The request was denied by the 8th Federal Civil Court of the DF.

João Santana and Mônica Moura’s company was fined by the Revenue in 2017, in the aftermath of Lava Jato. According to the investigations, the resources they received for the services provided to the PT, in 2014, were deposited by Odebrecht with resources diverted from Petrobras.

The defense can still take the discussion to the common court. The advertisers’ lawyers could not be located until the publication of this text.
