Minister Kassio Nunes Marques, of the STF (Federal Supreme Court), asked institutions such as the AGU (Advocacy-General of the Union) and the PGR (Attorney-General of the Republic) for information to analyze the action brought by President Luiz Inácio Lula da Silva and by the AGU, which demands that the Union has voting power proportional to its stake in Eletrobras.
The magistrate decided to adopt the abbreviated rite for the assessment of the process, in which the trial will take place directly on the merits without granting a preliminary injunction. He justified the determination “in view of the relevance of the matter and its repercussions on the social order and legal security”.
“I activate the rite of article 12 of Law n. 9.868/1999, without prejudice to any review by this Rapporteur. Information is collected within ten days, as well as the manifestation of the Attorney General’s Office and the opinion of the Attorney General’s Office, successively, within a period of five days”, he said, in a dispatch.
Last week, a report by Reuters showed that, close to completing one year of privatization, Eletrobras once again had to live with uncertainties of political bias, with no deadline to be resolved, in the face of the Union’s attempt to increase its power in the company
Sources close to the process see little chance of success for the government’s action in the Supreme Court.
