Judge grants injunction in dispute surrounding the Good Crop – 07/14/2023 – Mônica Bergamo

The District of Formosa of the Court of Justice of Goiás determined that a dispute over the inheritance of the founder of Boa Safra Sementes, Neri Colpo, be communicated to all the commercial boards in which the agricultural company is registered.

The decision responds to a request by Hostílio Ribeiro dos Santos Neto, son of the businessman who was born out of the marital relationship and won recognition of paternity in court. “I verify that such a measure is necessary, given that the fact is still under discussion between the parties”, said Judge Lucas Siqueira.

Last year, Boa Safra Sementes presented a balance sheet in which it recorded a net income of more than R$ 1 billion from the sale of soy seeds. Currently, Hostílio claims his share of the company’s shares.

With the communication of the litigation to the trade boards, Hostílio’s defense seeks to alert the partners and shareholders that, if he is victorious, the company’s shareholding structure will be impacted. The preliminary decision also prevents assets in the name of Boa Safra from being sold until the outcome of the case.

“Hostílio has the right to a shareholding in the companies that were constituted from the assets that would be, in part, his by inheritance”, says the lawyer Fábio Vilar, from the Nelson Wilians Advogados law firm.

“The measure has a precautionary and protective basis, in the sense of hindering potential asset squandering during the course of the process, to the detriment of the newly declared heir, by consanguineous brothers who appear as partners in the formal frameworks of the business group”, he also says.
