INSS: see the new value of the retirement floor – 05/02/2023 – Market

The social security floor paid in retirement, pensions and benefits from the INSS (National Institute of Social Security) became R$ 1,320 this Monday (1st), following the new value of the minimum wage published by the government of President Luiz Inácio Lula da Silva. Silva (PT).

Payment of the new amount begins on May 25, following the Social Security calendar. The release of values ​​is made according to the final number of the benefit, without considering the check digit.

Between May 25 and June 7, they receive policyholders who are entitled to the floor, including beneficiaries of the BPC (Continued Provision Benefit).

With the change in value, before at R$ 1,302, BPC (Benefit of Continuous Provision), INSS arrears, PIS/Pasep bonus, unemployment insurance and social security contributions that have the minimum as a basis will also be changed.

According to the INSS, the amount paid by the government will increase by R$ 3.29 billion in the agency’s budget. The calculation considers only the benefits of the FRGPS (General Social Security Regime Fund).

The readjustment of the minimum wage, which is also the minimum wage for INSS pensions, was announced by Lula in a speech on TV this Sunday (30).

The increase in the social security floor will not change benefits above the minimum, which are readjusted once a year, by the INPC (National Consumer Price Index), by the IBGE (Brazilian Institute of Geography and Statistics), nor by salary values ​​and rates contribution rates are the same for benefits above R$1,320.

See everything that will change with the minimum wage readjustment

1 – INSS DELAYS

Actions initiated in the JEFs (Federal Special Courts) are limited to 60 minimum wages. When the minimum wage goes up, the maximum value for this type of process also has an adjustment. From now on, they will be able to file a lawsuit in the insured JEFs whose total value of the process is up to R$ 79.2 thousand.

Before, the amount was R$ 78,120. These actions are called Small Value Requests (RPVs).

They are entitled to receive for RPV policyholders who initiated actions for granting and reviewing benefits in Federal Special Courts in the amount of up to 60 wages. Arrears of up to five years prior to the review request are due, plus the waiting time to receive the increase, if entitled.

Payment is made within two months of the judge’s order to settle the amounts, when the process comes to an end.

2 – PIS/PASEP ALLOWANCE

The PIS/Pasep allowance is paid to workers who, in the base year, had a professional activity with a formal contract or as civil servants receiving up to two minimum wages. You must have been registered with the PIS/Pasep for at least five years and have the data correctly informed by the employer in the Rais (Annual List of Social Information) or in the eSocial.

The amount paid varies according to the number of months worked in the base year and, from now on, will range from R$ 110 to R$ 1,320.

The salary bonus paid in 2023 is related to the work done in 2021. According to the Ministry of Labor and Employment, bonuses will be paid to 22.9 million workers entitled to receive the benefit, of which 20.4 million are entitled to PIS and others. 2.5 million entitled to Pasep, totaling around R$ 22 billion.

The payment schedule follows the dates approved by Codefat (Deliberative Council of the Workers’ Support Fund) in December, according to Sheet anticipated.

3 – UNEMPLOYMENT INSURANCE

The new minimum wage adjustment will also change the minimum amount paid for unemployment insurance in 2023, which will rise from R$1,302 to R$1,320. The benefit is paid according to a formula that considers the average of the three salaries prior to dismissal. There are three possible income ranges, the lowest of which is R$ 1,320 as of now.

4 – SOCIAL SECURITY CONTRIBUTIONS

Pensions paid month by month will also change for policyholders who contribute to the national floor. This change, however, should only occur in GPSs (Social Security Guides) paid from June, with reference to the month of May.

Policyholders who contribute as optional or self-employed at rates of 11% or 20% will pay R$145.20 and R$264, respectively.

Low-income housewives, who contribute 5% of the minimum wage, now pay R$66. Those who are registered as MEI (Individual Micro-entrepreneur) may have to pay different amounts, according to the activity carried out.

The MEI base is 5% on the minimum, which amounts to R$66, but there is an additional fee depending on the activity. Those who work with commerce, industry and transport services need to add R$ 1.00 of ICMS —resulting in R$ 67. Services in general contribute with another R$ 5.00 of ISS, which equals R$ 71. those who contribute in both sectors are impacted by the incidence of the two taxes, which adds up to R$ 6 — R$ 72.

The exception is the MEI truck driver, who must contribute at least 12% of the minimum wage – which will correspond to R$ 158.40 in 2023. ISS and ICMS charges depend on the specifications of the load and the scope of the territory in which you travel.

5 – CAUSES IN THE SPECIAL CIVIL COURT

Those who will file a lawsuit in the Special Civil Court, former Small Claims Court, will also have a change in the limit value of the action, which is up to 40 minimum wages. Before, this total was R$ 52,080. Now, it goes to R$ 52.8 thousand.
