INSS releases payroll for BPC beneficiaries after decision by the Federal Supreme Court

INSS publishes instruction that allows banks to resume consigned credit for those who receive BPC The decision was announced after the Federal Supreme Court (STF) unanimously validated, on Monday (11), the legislation that allows the contracting of consigned loans by beneficiaries of social programs. What is the BPC The BPC is an assistance benefit for people with disabilities and elderly people aged 65 or over with low income. To receive it, you must prove that your per capita family income (per person in the family) is up to a quarter of the minimum wage. As the current minimum wage is R$1,320, to receive the BPC, the per capita family income of a person with a disability or elderly person over 65 years of age needs to be up to R$330. What about the payroll? The consigned loan is a type of loan in which the installment is deducted directly from the payroll or, in this case, in the value of the benefit received. According to the INSS, almost 5.5 million people received the Continuous Payment Benefit in August. Of this total, 1.7 million have at least one active loan contract. These contracts were signed before this possibility was suspended in March. Those who receive BPC can only commit up to 35% of their monthly income to the payroll loan, of which: 30% for payroll loan operations; and 5% for a credit card or benefit card. According to the INSS, in principle, the maximum interest rate must follow the same applied to loans for INSS retirees and pensioners. In August, the National Social Security Council (CNPS) approved the reduction of the maximum interest rate to 1.91% in the case of conventional payroll loans for INSS retirees and pensioners. Offer of payroll loans According to the agency, the granting of payroll loans to those who receive the Continuous Payment Benefit had been suspended since March of the year. However, during the processing of the Provisional Measure that resumed Bolsa Família, parliamentarians included in the text a permission for BPC beneficiaries to use up to 35% of the aid value for payroll loans. The INSS was then awaiting the STF’s decision to publish the normative instruction with the rules for payroll loans for BPC beneficiaries. From now on, interested banks can offer this line of credit again. Prohibition continues for Bolsa Família In the case of those who receive Bolsa Família, the federal government informed that it will maintain the prohibition on beneficiaries of the program taking out a payroll loan. According to the Executive, the objective of the measure is to “avoid debt for the population in vulnerable situations”. In the assessment of the Brazilian Institute of Social Security Law (IBDP), granting payroll loans to those who receive BPC can also lead to an increase in family debt. “We evaluate it as a situation of concern because the people who are beneficiaries of the BPC are low-income, it can compromise their income and cause family debt to rise”, defended Joseane Zanardi, coordinator of IBDP in São Paulo.
