INSS: Justice pays more than R$ 1 billion to retirees – 02/20/2023 – Market

The CJF (Federal Justice Council) released R$ 1.007 billion to pay overdue amounts to retirees and pensioners who defeat the INSS (National Social Security Institute) in court in actions to grant or review the benefit.

The amount will settle the institute’s debts with 66,216 beneficiaries, who won 50,524 cases of up to 60 minimum wages in all five regions of the country. Payment is made according to the schedule of each TRF (Federal Regional Court).

Called RPVs (Small Value Requisitions), this month’s arrears will already be issued according to the value of the new minimum wage, of R$ 1,302. As a result, the request limit is now R$78,120.

Who will receive this batch of arrears from the INSS?

Retirees, pensioners and other beneficiaries who:

• They won the INSS in court in an action to grant or review the benefit
• They won processes that have already reached the end, with no possibility of appeal by the INSS
• They are entitled to arrears of up to 60 minimum wages, called RPVs
• Had the payment order issued by the judge in January 2023

In all, the CJF released R$ 1.2 billion to pay the RPVs assessed in January by citizens who won 86,712 lawsuits against the government in the amount of up to 60 minimum wages. 108,165 people will benefit.

How are INSS arrears paid?

Policyholders who are entitled to RPVs receive the money at Caixa Econômica Federal or at Banco do Brasil in an account opened by the TRF in their region. The processing of values, which is the opening of these accounts for payment, is automatic and starts as soon as the money is released by the CJF.

In general, this processing lasts from one week to ten days, during which time the money will be available and can be withdrawn either by the insured person or his lawyer.

Processing is automatic and should not be interrupted during Carnival, but banks are limited during this period. Bank branches across the country were closed on Monday (20) and Tuesday (21). Service will resume on Ash Wednesday after noon.

In order to determine whether he will receive this lot, the insured person must make an appointment with his lawyer or on the website of the TRF responsible for his region. The query is made by informing the insured person’s CPF number or the lawyer’s OAB number. It is also possible to make the conference through the process number.

For policyholders in São Paulo and Mato Grosso do Sul, the query is made on the site trf3.jus.br. To find out if you are going to receive this batch, you must observe the month that appears in the “TRF protocol date” field. In February, policyholders whose arrears were cleared by the judge in January are received in February.

After payment, the information “total payment to the court” will appear.

UNDERSTAND THE DIFFERENCE BETWEEN PRECATORIES AND RPVS

Both the precatories and the RPVs are debts of the federal government in court. The difference between them is the value of the cause. When the action is up to 60 minimum wages, payment is made by RPV, which is a Small Value Requisition.

This type of arrears is paid, in general, within two months of the judge’s payment order, when the process comes to an end.

Precatories are actions above 60 minimum wages, paid once a year. Until 2026, constitutional amendment 114 is in effect, which limited the release of precatories. With that, the federal government released only part of the amounts in 2022. The other creditors will have to wait to receive in the coming years. The 2022 payments were made in August and September.
