How to settle debt protested at the registry office – 06/13/2023 – Market

More than 11 million individuals and companies paid off their debts with the government, but did not clear their names in protest notaries in Brazil, points out a survey by the IEPTB (Institute for Protest Studies on Titles in Brazil). Not canceling the pendency linked to the name can lead to difficulty in accessing credit lines.

According to the study, 57% of debts refer to debts with public authorities (Union, states and municipalities) and also with service companies, such as electricity.

HOW DO I ISSUE A CANCELLATION AUTHORIZATION?

After repaying the debt, the debtor must request a cancellation authorization, also known as a letter of consent, from the person responsible for the protest to carry out the cancellation.

José Carlos Alves, president of IEPTB-SP, explains that the company responsible for the debt protest is under no obligation to cancel. Debt cancellation must be carried out before the notary of the notary where the debt protest was registered.

“If the person does not cancel the protest, just continues with their credit shaken in the ‘square’, when they go to the bank to request credit or financing, this process will appear and the bank will not provide it”, he says.

To issue the authorization, simply access the Regularize portal of the Federal Revenue Service, by clicking on this link. On the website, select which type of certificate meets your needs:

1. Click on “Issue Certificate”;
2. Enter your CPF or CNPJ;
3. If everything is ok, the portal will start downloading the authorization
4. With the authorization in hand, just proceed with the process normally

According to Alves, not canceling the debt does not imply legal or direct consequences for the former debtor, but it could hinder the sale of properties, for example.

“If a potential buyer does research on the seller’s financial suitability, the protest will appear and it is unlikely that a buyer will want to acquire a good from a person who has registered protests against him”, he says.

HOW TO CANCEL THE DEBT?

Cancellation can be done online or in person. Through the internet, the service is available on the IEPTB’s Cenprot (Protest Registry) website, works for all states and is available from the 1st to the 23rd of each month. For this it is necessary:

1. Access the portal;
2. Select the “Free Consultation” option;
3. Then indicate the CPF or CNPJ;
4. Issue and pay the payment slip for the fees due for cancellation

It is also possible to settle debts protested by the State and the municipality of São Paulo through the website, together with the notary fees due for cancellation, simply:

1. Consult the CPF or CNPJ;
2. Check the discharge and cancellation amounts;
3. Pay the bill or make the transfer

There is an option to do this service in person. The interested party must attend the protest notary where his name is protested, with the letter of consent given by the creditor, with a notarized signature, and pay the fees to the notary.
