Health companies ask for autonomy from regulatory agencies – 02/14/2023 – Panel SA

The health sector’s movement against the amendment presented this month by federal deputy Danilo Forte (União-CE) to provisional measure 1,154 has grown.

In the MP, which deals with the organization of bodies under the new government, the amendment proposes the creation of councils linked to the ministries, to deliberate on normative activities together with the agencies.

The amendment is seen in the industry as an attempt to undermine the autonomy of regulatory bodies. Thirty associations linked to the health sector published this Monday (13) a manifesto in which they point out the risk of a “regression in sanitary control”.

“The proposed amendment to transfer the normative competence of federal regulatory agencies to external councils violates the constitutional legal order, which enshrines administrative independence, stability of leaders, financial autonomy, and, consequently, the decision-making and political independence of these autarchies” , says the manifesto.

The document, signed by entities such as Abraidi, CNSaúde, FarmaBrasil, Sindusfarma, SindHosp and Anahp, states that the agencies are composed of specialists in the subject to be regulated and their decisions are technical in nature, based on studies.

For the health sector, the concern is with ANS (National Supplementary Health Agency) and Anvisa. “Its decisions are taken based on evidence, in spite of external pressures, which increases its credibility and confidence in society, in defense of health, as experienced in the pandemic”, says the text.

The amendment covers other agencies, such as ANTT (transport), Anatel (telecommunications) and Anac (aviation), whose regulated sectors also raise criticism.
