They are: Rose Leonel law (13.772/18): it considers the “unauthorized recording of sexual intimacy” to be a crime; punishment is six months to 1 year of detention; law 13.718/18: criminalizes the “dissemination of rape, sex or pornography scenes without consent”, including sharing; the penalty varies from 1 to 5 years of imprisonment. It provides for aggravation of the penalty if the perpetrator maintains or maintained an intimate relationship of affection with the victim or if the act is for revenge or humiliation, which characterizes “revenge pornography”. Although the laws provide for imprisonment, the most common thing in Brazil is for the issue to be resolved with fines or volunteer work, says lawyer Iolanda Garay, president of the National Association of Internet Victims (Anvint). “But it is very important that the victim understands that, even if he (the criminal) is not arrested, he will be responding and this could have a series of negative consequences for him”, completes Iolanda. Co-worker exposed the photos Dance teacher Rhuanna Nurrelly, from Garanhuns (PE), was the victim of image exposure intimate in 2014. Her case is a little different: the person who made the images public was a co-worker. An ex-boyfriend of Rhuanna’s shared her photos with a friend who, in turn, was dating this co-worker. Rhuanna’s boyfriend’s friend sent messages harassing the teacher. Upon learning this, the colleague became jealous and decided to publish the images on Facebook. “The moment I saw it, when I got the news, it was a blow. You don’t expect your trust exchange moment to be open to all people. So it’s a punch in the gut. There’s no explanation for the feeling of pain and shame”, tells Rhuanna. “The whole professional issue comes, the whole family context. You think about your future relationships, that it’s all over. So, it’s really that moment when you look to the side and see no way out”, she completes. After the attack, Rhuanna was away from work. The disclosure took place when she was starting a new relationship, which ended after the boy did not feel comfortable in a relationship with someone who has public intimate photos. With the disclosure of the case in the press, the former colleague had to leave the city. Discouraged by the lawyer, Rhuanna did not want to go to court. “The words I got from the lawyer were that it really wasn’t going to go anywhere. That would take years,” she recalls. “The most I would get, if I got anything, was that the person, being discovered, would pay for basic food baskets or volunteer work for months, but that would only bring me back to this bad visibility”. But she decided to do a sensual photo shoot to show her body in her own way. 8 years of being threatened Joana* is virtually pursued by her ex-boyfriend and has suffered several threats for over eight years. She has already been physically assaulted and fears that he will disclose the images they exchanged, considering that he published photos of his ex-girlfriends on porn sites. When she discovered this history, she ended the relationship. “To this day, I live in fear of this content leaking. I lived all these years cornered and afraid. This affected my professional and marital life, destroyed my last relationship and how I transferred this figure from the aggressor to my partner at the time”, tells Joana*. “I’m sure I didn’t collaborate so that these things could happen to me. I didn’t allow him to film us in the sexual act and every time we exchanged images I asked him to delete it. I worked with the confidence in it,” she reports.
